Personal data is all data that can be related to you personally, such as your title, name, address, e-mail address, IP address, etc. Your personal data will only be collected and processed by us in accordance with the provisions of EU Datenschutzgrundverordnung (“DSGVO“) and other provisions of European and applicable national data protection law.

This privacy policy applies exclusively to our website. If you are redirected from our website to websites or apps of third parties via links from our website, please inform yourself there about the respective handling of your data.

Explanations of the legal basis and the storage period

3.1. Legal bases for the processing of personal data

If we obtain your consent for the processing of personal data, Art. 6 Abs. 1 a) DSGVO is the legal basis for the processing of personal data. Any consent can be revoked by you with effect for the future.
For the processing of personal data necessary for the performance of a contract with you or your company, Art. 6 Abs. 1 b) DSGVO is the appropriate legal basis. This also applies to processing operations that become relevant prior to the conclusion of a contract.

As far as the processing of your personal data is necessary to fulfil one of our legal obligations, Art. 6 Abs. 1 c) DSGVO serves as legal basis.
If the processing is necessary to protect a legitimate interest of our company or a third party and your interests, fundamental rights and freedoms do not outweigh our legitimate interest, Art. 6 Abs. 1 f) DSGVO serves as the legal basis for the processing.

3.2. Storage duration and deletion of data

The personal data collected, processed and stored by us are only stored by us for as long as the concrete purpose of the storage requires. If the purpose of storage ceases to apply, your data will be deleted or their processing will be restricted.

In addition, however, it may be that European regulations, applicable national laws or other regulations require longer storage of the data processed by us. If these storage periods expire, we will delete your data or restrict the processing of them.

Your rights

As far as we process personal data from you, you are a “person concerned” in the sense of the DSGVO. As a data subject, you are entitled to the following rights against ZeKju:

4.1 Right of access to the processing

Within the framework of the legal provisions, you can at any time request information from us as to whether personal data is being processed by us. If this is the case, you have the right to request information about the scope of data processing (Art. 15 DSGVO).

4.2 Right of rectification

You have the right to ask ZeKju to correct and/or complete your data if the processed personal data concerning you is incorrect or incomplete (art. 16 DSGVO).

4.3 Right to restrict processing

If the conditions for this are met, you can request the restriction of the processing of your personal data (Art. 18 DSGVO).

4.4 Right of cancellation

You may request ZeKju to delete personal data concerning you immediately, provided that the conditions for this are met. The right of cancellation does not apply if the processing is necessary (art. 17 DSGVO).

4.5 Right to information

If you have exercised your right to rectify, erase or limit processing vis-à-vis ZeKju, ZeKju is obliged to notify all recipients to whom the personal data concerning you have been disclosed of this rectification, erasure or limitation of processing, unless this proves impossible or involves a disproportionate effort. The data controller will inform these recipients if you so request (Art. 19 DSGVO).

4.6 Right to data transferability

You have the right to receive the personal data concerning you that you have provided to ZeKju in a structured, common and machine-readable format. You also have the right to have this data communicated to another company, without obstruction from ZeKju, to which the personal data has been provided, provided that the conditions for this are met(art. 20 DSGVO).

4.7 Right of objection

You have the right to object at any time, for reasons arising from your specific situation, to the processing of personal data concerning you, which is carried out on the basis of Art. 6 Abs. 1 f) DSGVO(Art. 21 Abs. 1 DSGVO). As a consequence of the opposition, ZeKju will no longer process the personal data concerning you, unless ZeKju can demonstrate compelling reasons for processing that are worthy of protection, which outweigh your interests, rights and freedoms, or unless the processing serves to assert, exercise or defend legal claims.
If the personal data concerning you are processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing(Art. 21 Abs. 2 DSGVO).

4.8 Right to revoke the declaration of consent under data protection law

If you have submitted a declaration of consent under data protection law, you can revoke it at any time(Art. 7 DSGVO). The revocation of consent does not affect the legality of the processing that took place on the basis of the consent until the revocation.

4.9 Right of appeal to a supervisory authority

Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State in which you are resident, your place of work or the place where the alleged infringement occurred, if you consider that the processing of personal data concerning you is in breach of the DPA (Art. 77 DSGVO).

Visit to the ZeKju website

Each time you access our website, our system automatically collects data and information from your computer system. In particular, the following of your data is collected:

  • the page from which the file was requested
  • the name of the file
  • the date and time of the request
  • your stay
  • the amount of data transferred
  • the access status (i.e. whether the file was transferred or possibly not found etc.)
  • the anonymous IP address of the requesting computer
  • a description of the type and version of the web browser used
  • the installed operating system and the set resolution

The aforementioned data we collect about you is stored in the log files of our system. A storage of these data together with other personal data does not take place in principle. 
The legal basis for the temporary storage of data and log files is Art. 6 Abs. 1 f) DSGVO. We have a legitimate interest in collecting and temporarily storing the aforementioned data, as the temporary storage of the IP address by the system is necessary to enable the website to be delivered to your computer.

Storage in log files is done to ensure the functionality of the website. In addition, this data serves to optimise our website and to ensure the security of our information technology systems. An evaluation of your log files for marketing purposes does not take place. 
The data is deleted or alienated so that it can no longer be assigned to you as soon as it is no longer required for the purpose stated here. If the data is stored in log files, the data is usually deleted after seven days.

Contacting ZeKju

6.1. By e-mail and telephone

Our website includes an e-mail address and a telephone number which you can use to contact us. If you send us an e-mail, we will save your e-mail address and any other data you provide. Even if you call us, it is possible that we will save the data we need to answer your inquiry. The legal basis for the processing is Art. 6 Abs. 1 b) und f) DSGVO, as contacting us may involve the initiation of a contract. However, ZeKju also has a legitimate interest in processing your data in order to be able to reply to you.

In the event that we wish to use your data, in particular your telephone number or e-mail address for marketing purposes, we will ask you in advance for your consent. In this case Art. 6 Abs. 1 a) DSGVO is the legal basis. You can withdraw your consent at any time with effect for the future. In the case of direct marketing, we also base the processing of the data on our legitimate interest according to Art. 6 Abs. 1 f) DSGVO.

The data will be deleted as soon as they are no longer required for the purpose of their collection and no legal or contractual archiving obligations prevent their deletion. The conversation ends when it is clear from the circumstances that the matter in question has been conclusively clarified.
At the time of sending your message the following data will also be saved:

  • Your IP address and
  • Date and time of your contact.

These other personal data processed during the sending process serve to prevent misuse of the e-mail and to ensure the security of our information technology systems. Any additional personal data collected during the sending process will be deleted after a period of seven days at the latest. The data will be used exclusively for processing the conversation. The legal basis for the processing of the data is Art. 6 Abs. 1 f) DSGVO.

6.2. By contact form

On our website there is a contact form which you can use to contact ZeKju electronically. If you take this opportunity, the data entered in the input mask will be transmitted to us and stored.
The legal basis for the processing of the data is art. 6 Abs. 1 a), b) or f) DSGVO. The processing of personal data from the input mask of our contact form serves us – in addition to the above-mentioned purposes – solely to process your request, which is in our interest. This can be e.g.  B. for the initiation of a contract. The data will be deleted as soon as they are no longer required for the purpose for which they were collected and there are no legal archiving obligations to prevent deletion. The conversation ends when it can be concluded from the circumstances that the relevant facts have been finally clarified.  At the time of sending your message the following data will also be saved:

  • Your IP address;
  • Date and time of your contact.

These other personal data processed during the sending process serve to prevent misuse of the contact form and to ensure the security of our information technology systems. The legal basis for the processing of the data is Art. 6 para. 1 f) DSGVO. Any personal data additionally collected during the sending process will be deleted after a period of seven days at the latest. The data will be used exclusively for processing the conversation.

Use of cookies and marketing measures

7.1. Cookies in general

In addition to the data mentioned above, when you use our website, various types of cookies are used and stored on your computer or mobile device. Cookies are small text files that are stored on your computer or mobile device when you visit our website. We receive various types of information when cookies are set.

We use the data collected by cookies for as long as they are required for the respective purpose stated.

7.2. Cookies used

7.3. Google analytics

The ZeKju website uses Google Analytics, a web analytics service. The provider is Google Ireland Ltd, Gordon House, Barrow Street, Dublin 4, Ireland (“Google”). This is used to analyse user behaviour in order to optimise both our website and our advertising. Google Analytics uses “cookies”. The information generated by the cookie about the use of our ZeKju website is transferred to Google servers in the USA and stored there.

On the ZeKju website, Google Analytics is used with activated IP anonymisation, which means that your IP address will be truncated within member states of the European Union and the other contracting states of the Agreement on the European Economic Area (“EEA”). Only in exceptional cases will the complete IP address be transmitted to a Google server in the USA and shortened there.

Google has submitted to the EU-US Privacy Shield, https://www.privacyshield.gov/EU-US-Framework. We have also concluded a contract with Google with so-called standard contract clauses in which Google undertakes to process user data only in accordance with our instructions and to comply with the EU data protection level.

Google uses this information on behalf of ZeKju as operator of the website to evaluate your use of our online offer, to compile reports on website activity for ZeKju and to offer further services associated with website activity and Internet use.

The use of Google Analytics is justified in accordance with Art. 6 Abs. 1 a) DSGVO, provided that you have given your consent when visiting the ZeKju website. You can revoke your consent at any time with effect for the future. We will only process your data for as long as it is necessary for the purpose of data collection (in this case the compilation of statistics and their evaluation). The data sent by us and linked to cookies, user IDs (e.g. user ID) or advertising IDs will therefore be automatically deleted after 14 months.

Security Standards

ZeKju has implemented appropriate physical, technical and administrative security standards to protect personal information from loss, misuse, alteration or destruction. Our service providers and affiliates are contractually bound to maintain the confidentiality of personal information. In addition, they are not permitted to use the data for purposes not authorised by us.

Since the security of your data is important to us, your entire visit is handled via a secure TLS connection. If personal data is collected, the data transfer is also TLS-encrypted. The TLS encryption process protects your data from unauthorized access as it travels through the Internet.
